affirmative defenses – Defenses that can remove or lessen your liability when the standard requirements of a charge or claim against you are met. Say you borrow Bob’s truck without permission. Normally, you’d be liable for trespass to chattels but the affirmative defense of public necessity applies because you used the truck to shuttle people out of harm’s way.
